Our Terms & Conditions comply with UK and EU legislation and are provided to help our customers shop safely and securely on the Internet. Please read these Term & Conditions carefully prior to placing your order. These are the terms and conditions on which we supply the products and goods listed on this website (“Products”) to you.

Intellectual Property

The contents of our website, including logos, trademarks and photos along with written text are the property of Apelson Appliances UK Ltd and its partners. None of the content or software held on this site must be reproduced, copied, sold or downloaded without written permission form us. Viceroy branding is provided and licensed for use by Wren Kitchen Ltd.

Liability

We shall not be liable to you, whether in contract, tort (including negligence), breach of statutory duty or otherwise for incidental or consequential damages of expenses caused by the sale of Products from this site. This includes, but is not limited to, damage to property, lost income, profits, economic or commercial losses and third party claims.

Our total liability to you all other losses arising under or in connection with the contract between us shall be limited to 120% of the Products.

We will do our very best to get all orders dispatched as quickly as possible. However, we are not liable for delays in despatch or delivery of products ordered. You have the right to cancel delayed orders at any time prior to dispatch and receive a full refund unless special orders.

These Terms & Conditions do not affect your legal rights and we do not exclude or limit in any way our liability to you where it would be unlawful to do so.

Price, Delivery Charges and Availability

Unless otherwise stated, prices for Products are inclusive of applicable sales tax. Sales tax will be applied and will be shown on your invoice at the current applicable rate. Sales tax amounts stated may be subject to rounding variances. The exact amount of sales tax will be shown on the sales tax invoice (where provided). This will not affect the total price inclusive of sales tax.

Prices for Products exclude delivery charges unless expressly stated otherwise. Delivery charges vary depending on the Product(s) you order, the delivery address and the delivery method you select; please see our Delivery Terms for further details. When you place an order via our Website, delivery charges are calculated automatically in your shopping basket depending on your choices and added to your order.

We may update prices at any time. Despite our best efforts, a small number of the thousands of products we sell may occasionally be mispriced. If this happens then we will not be obliged to supply the Products at the incorrect price or at all. We will (at our discretion) either cancel your order and refund the price you have paid or endeavour to contact you and ask you whether you wish to continue with the order at the correct price. If we are unable to contact you or you do not wish to continue with the order at the correct price, we will cancel your order and refund the price you have paid.

From time to time we may apply promotional prices to Products. These promotional prices will only apply in the context in which the promotion is given and are subject to the terms of that promotion. We may update promotions at any time.

Where we provide a quote to you it will be subject to the terms and conditions applicable to that quote.

All Products are subject to availability. The website will only allow orders to be placed when we have stock. If parts are not available, they cannot be ordered. If ‘Contact Us’ is shown next to the Availability, then you can make an enquiry as to availability of the part.

We may make minor changes to the Products to reflect changes in law or to reflect technical adjustments.

We aim to dispatch stock parts on the same day as order if placed before 4pm. Our standard delivery time is 48 hours within the UK and 3 to 5 days for the rest of Europe. Deliveries are made between 8am to 6pm Monday to Friday. Non-stock, special order, delivery lead times will be quoted per order.

Our carrier will contact you if the driver is unable to locate your property. Under normal circumstances the driver will require a signature to release the Products. If you are out, a card will be left giving re-delivery / collection instructions. Under current COVID regulations signatures will not be required by the carrier will take an image of delivery location where possible.

Order / Delivery Information and contract formation

Upon receipt of your order you will be sent a confirmation email, acknowledging the order and giving stock availability information. At this point a contract will come into existence between you and us. You will also be sent a further email confirming dispatch of your order.

Payment

The total cost of your order and/or purchases is the price of the Products and applicable delivery charges.

We must receive payment in advance before your order and/or purchase can be processed, unless we have agreed otherwise in advance in writing.

Payment can be made by most major credit or debit cards, and by other online payment methods (including PayPal Apple Pay and Google Pay)

If you use a credit/debit card to pay for your order, you must use your credit/debit card or a credit/debit card that you are otherwise authorised to use. All credit/debit card holders are subject to validation checks by third parties and authorisation by the card issuer. If the issuer of the card refuses to authorise payment or any other validation checks return adverse results, we will not accept your order and we will not be liable for any delay or non-delivery and we are not obliged to inform you of the reason for the refusal. If you use PayPal to pay for your order and the issuer of the card or the payment provider that operates the account that you use to fund or which is linked with your PayPal account refuses to authorise payment, we reserve the right to reject your order and will not be liable for any delay or non-delivery and we are not obliged to inform you of the reason for the rejection.

We are not responsible for the card issuer or bank charging the cardholder as a result of our processing of the credit/debit card payment in accordance with your order.

Returns Policy

We hope you will be delighted with your purchase but in the event you wish to return it you must do so using the following procedures. Please note that you must enclose the original delivery note when returning parts.

Surplus To Requirements

If you no longer require the part you must notify us within 14 days from receiving your delivery. We will issue a Returns Authorisation Number and request that you return the item to our warehouse address below. The part must be unused and in the original packaging to allow us to process a credit. 

Faulty Products

Parts are covered by a 30 day parts and labour warranty if fitted by an Authorised Apelson Service Agent. If you decide to fit the parts yourself, no manufacturer warranty is provided. If you have experienced a part failure when fitted by a Apelson approved engineer, please Contact Us immediately to arrange for an engineer to check the failure. If you have fitted the part yourself, you may return the part for inspection. If the part has failed prematurely, we will refund the cost of the part and carriage. If no fault is found no refund will be given.

Cancellations and consumer rights

Orders for stock parts may be cancelled at any time before they are dispatched. Please Contact Us immediately if you need to cancel an order. Special orders (non stock items) cannot be cancelled and you will be charged (unless you are a consumer, as detailed below).

Rights in the United Kingdom as a consumer

If you are a consumer in the United Kingdom, then for most Products bought online, you have a legal right to change your mind within 14 days and receive a refund. These rights, under the Consumer Contracts Regulations 2013, are that you have 14 days after you receive the Products to change your mind. You cannot return the Products in that period if any Products become mixed with other goods after delivery.

To end the contract under this clause, please let us know by email, phone or by using the form Contact Us and send it to us online or post it to us.

Events beyond our control

We shall have no liability to you for any failure or delay in supply or delivery, nor if performance of any of our obligations is prevented or restricted, nor for any damage or defect to Products supplied or delivered under our agreement, in each case that is caused by any event or circumstance beyond our reasonable control (including, without limitation, the following to the extent these are outside our reasonable control: accidents, extreme weather conditions, fire, explosion, flood, storm, earthquake, natural disaster, failure of telecommunications networks, inability to use transport networks, acts of God, terrorist attack, war, civil commotion, riots, strikes, lockouts and other industrial disputes, acts or restraints of Government, and imposition of restrictions on imports or exports).

Product Specification & Suitability

We ensure that the information provided on this website is as up to date as possible. From time to time manufacturer specifications, part numbers and finished products may vary from the original fitted to your appliance. If you have ordered an item that is unsuitable, we will refund you in full upon the return of the item, less the cost of collection.

Please note that we only supply original manufacturer parts unless specifically noted in the description of the part.

Security & Privacy

We recognise the importance of protecting the privacy of all information provided by users of this website. Your personal information may be disclosed to other businesses within the Apelson Appliances UK Ltd group of companies to enable us to carry out accounting and dispatch processes. We will not pass on your details to any Third Party without your permission.

We take web security very seriously and take every precaution to protect our customer’s personal information. Our procedures and policies comply with the Data Protection Act 2018 and the GDPR (General Data Protection Regulation 2016/679).

Your information

In the course of our dealings with you we will collect and process personal information about you, including to administer and process your order, and to provide the Products. Further information on the manner in which we process personal information is set out in our Privacy Policy, a copy of which is available on our Website.

Calls to our contact centre may be monitored and/or recorded for quality control and training purposes.

Sales Disclaimer

The spare parts supplied by us are genuine manufacture replacement parts that will fit your appliance. Using non-genuine parts may affect the operation of your appliance and may be a safety hazard. All our service parts are warrantied if fitted by an affiliated Viceroy engineer or Apelson Service Partner.

‘In Warranty’ Products

Please note that if your appliance is still under warranty you must contact your regional Service Help Desk by calling the Service Hotline in your User Instruction Manual. If you go ahead and replace parts you will invalidate your warranty and you will be charged for subsequent service call outs. If you do not have access to your User Instruction Manual, please use the ‘Contact Us’ page and we will assist.

‘Out of Warranty’ Products

We highly recommend not replacing electrical or gas specific spare parts unless you are experienced or qualified to do so. If you are in any doubt, we strongly recommend you contact your regional Service Help Desk to discuss using an affiliated engineer or service partner who have experience with Viceroy products. If you wish to contact us please use the ‘Contact Us’ page and we will assist.

For safety reasons, we reserve the right to restrict sales of gas spare parts to professionally registered gas engineers.

Other terms

We may transfer our rights and obligations under these terms and conditions to another organisation.

Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of these terms are unlawful, the remaining paragraphs will remain in full force and effect.

Any dispute or claim arising out of or in connection with a contract between us or its subject matter or formation shall be governed by and construed in accordance with the law of England and Wales and the courts of England and Wales shall have exclusive jurisdiction to settle any such dispute or claim.
